Mexico's 40-hour workweek reform: what changes and how to prove every workday

Mexico's maximum workweek drops from 48 to 40 hours between 2026 and 2030. What HR, Operations and Legal need on their radar, and how to record and prove every workday.

FieldWy Team ·

The labor reform published in Mexico's Official Gazette (DOF) in 2026 gradually reduces the maximum workweek from 48 to 40 hours between 2026 and 2030, with no reduction in pay or benefits. For many companies, the challenge isn't just adjusting schedules: it's being able to prove, with reliable evidence, that every workday complies.

What to have on your radar

  • Working hours: define schedules, work modes, duration and distribution in line with Article 123 of the Constitution and the Federal Labor Law (LFT).
  • Overtime: record actual time, reason, review, authorization and payment.
  • Rest: manage breaks during the day, weekly rest, Sundays and public holidays.
  • Time records: have reliable mechanisms to record start and end times, consult history, document changes and export evidence.
  • Remote work: assess conditions, tools and the right to disconnect under NOM-037-STPS-2023.
  • Privacy: minimize data, control access and retain information in line with the applicable framework.

Every work mode, with its own evidence

Office, field, remote, hybrid and night shifts each have their own reality. A field crew doesn't record its workday the same way an office team does, and a shift that crosses midnight needs its own rules.

A daily compliance cycle

With FieldWy FLOW and its mobile app, compliance becomes a daily, traceable cycle:

  1. Plan hours, calendar, work mode and rest.
  2. Record start, end and exceptions from a phone, even offline.
  3. Validate limits, deviations and overtime with rules.
  4. Resolve adjustments with approval and justification.
  5. Reconcile records and exceptions against payroll.
  6. Prove compliance with an auditable file and reports.

The app captures; FLOW applies rules, orchestrates clarifications and approvals, and keeps the evidence.

Start before it's urgent

The transition is gradual, but the evidence is built from day one. See the full guide on our 40-hour workweek reform page.
